These Terms & Conditions apply to all users of bama-heritage.com (the “Site”) and to all purchases of products sold by Bama Heritage SARL.

The Site is built on WordPress. These Terms govern your use of the Site and your purchase of our products.


2. Products – Extra Virgin Olive Oil

We sell premium, cold-pressed extra virgin olive oil. Product descriptions, images, and nutritional information are provided for general reference. Because olive oil is a natural agricultural product, slight variations in color, taste, or aroma may occur between harvests.

Allergen information: Our olive oil is 100% pure and produced in a facility free from common allergens (no nuts, dairy, gluten, soy, or eggs). If you have specific allergies, please contact us before ordering.


3. Eligibility to Purchase

To place an order, you must be at least 18 years old. By ordering, you confirm that you meet this age requirement and that all information you provide is accurate, complete, and up to date.


4. Order Process & Contract Formation

When you place an order, you will receive an order acknowledgment email. This email does not mean we have accepted your order. A legally binding contract is formed only when we dispatch the goods and send you a shipping confirmation email.

We reserve the right to cancel any order before dispatch if:

  • The product is unavailable.

  • There is an error in pricing or product description.

  • We suspect fraud, unauthorized transaction, or violation of these Terms.


5. Prices, Taxes & Payment

All prices are displayed in Moroccan Dirham (MAD) or your local currency depending on your location and our WordPress plugin settings. Shipping costs are calculated at checkout and added to the total price.

Taxes and duties: For international orders, you are responsible for any import duties, customs fees, VAT, or other taxes imposed by your destination country. We are not responsible for delays caused by customs.

Payment methods: We accept major credit cards (Visa, Mastercard, American Express), PayPal, and other methods shown at checkout. Payment is taken at the time of order. All transactions are secured using SSL encryption.


6. Shipping & Delivery – Worldwide

We ship worldwide. Delivery times and costs vary by destination and are estimated at checkout. Estimated delivery times are provided in good faith but are not guaranteed, especially for international shipments.

Shipping carriers: We use national and international carriers such as Aramex, DHL, FedEx, or local postal services. A tracking number will be provided once your order is dispatched.

Risk of loss: The risk of loss or damage to products passes to you when we deliver the products to the carrier. We are not responsible for delays, loss, or damage caused by the carrier after dispatch.


7. Right of Withdrawal & Returns (Cooling-Off Period)

Because we sell food products (extra virgin olive oil), the right of withdrawal may be limited for health and safety reasons. However, we offer the following return policy in good faith:

  • 14-day cooling-off period (for customers in the European Union): If you are a consumer in the EU, you have the right to cancel your order within 14 days of receiving the goods without giving any reason.

  • Exception: The right of withdrawal does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons and that were unsealed after delivery. If you have opened the bottle or broken the seal, we cannot accept a return.

  • For all other customers (outside EU): Returns are accepted only if the product is unopened, unused, and in its original sealed packaging. You must contact us within 7 days of delivery to request a return.

How to return: To exercise your right of withdrawal, contact us at [email protected] with your order number. You will receive instructions.

Return shipping costs: You are responsible for return shipping costs unless the product is defective or we made an error.

Refunds: Once we receive and inspect the returned unopened product, we will refund the purchase price within 14 days using the original payment method. Shipping costs are non-refundable.


8. Defective or Damaged Products

If you receive a product that is defective, damaged during transit, or not as described, please contact us within 48 hours of delivery with your order number and clear photos of the defect or damage. We will, at our option:

  • Replace the product at no cost, or

  • Issue a full refund including shipping costs.


9. Warranty & Disclaimer

Our extra virgin olive oil is guaranteed to be fresh, authentic, and of food-grade quality at the time of delivery. However, because olive oil is a natural product, we do not warrant that it will meet your personal taste preferences.

To the maximum extent permitted by Moroccan law and applicable international law, we disclaim all other warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose.


10. Liability Limitation

To the fullest extent permitted by law, Bama Heritage SARL, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or Site, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the product giving rise to the claim.


11. Intellectual Property

All content on bama-heritage.com, including text, graphics, logos, images, and product descriptions, is the property of Bama Heritage SARL and is protected by Moroccan and international copyright laws. You may not reproduce, distribute, or use any content without our prior written permission.


12. Force Majeure

We are not liable for any delay or failure to perform our obligations if the delay or failure is caused by events beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, pandemics, strikes, supply chain disruptions, or government actions.


13. Governing Law & Dispute Resolution

These Terms and any purchase made on bama-heritage.com are governed by the laws of Morocco, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your purchase shall first be attempted to be resolved amicably through good-faith negotiations. If the dispute cannot be resolved within 30 days, it shall be submitted to the competent courts of Guercif, Morocco.

For consumers residing in the European Union, you may also use the European Commission’s Online Dispute Resolution platform (ec.europa.eu/odr), but we are not obliged to participate in any alternative dispute resolution scheme.


14. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. The latest version will always be posted on this page with the effective date. Your continued use of the Site or placement of an order after changes are posted constitutes your acceptance of the revised Terms.
